General Conditions of school programs

These General Conditions are subject to whatever results from the application of the R.D.L. 1/2007 of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users. Law 7/1998, of April 13, on the General Contracting Conditions, and the Civil Code.

All registration must be made sufficiently in advance (maximum 21 days before the start date of the Program, except in Programs that have a different deadline) and be accompanied by €300 for Programs in Spain, €600 for Programs in Europe. and €1,000 for Programs in countries outside the European Union. (Without such delivery, it is not considered firm). This amount will be deducted from the total amount. The Program must be paid in full against the delivery of the necessary documentation to carry it out and always before its start. Registrations are personal, and non-transferable for Programs that require a visa. To enroll in a Program you must complete all the enrollment forms required by the chosen Program.

In the event that a consumer decides to cancel the contracted Program, he must notify Youth and Culture in writing. The consumer will have the right to a refund of the amounts that he had paid to Youth and Culture. However, the consumer must pay Youth and Culture the amount corresponding to the damages that have been caused, which are the management costs and, if any, the cancellation costs. Youth and Culture charges €300 in all Programs for management unless another figure is indicated in the particular conditions of the specific Program. This amount is included in the price of the Program that is included in the brochure.

These penalties will not operate in the event that the cancellation, by the consumer, is due to a force majeure reason.

Without prejudice to the moment in which the cancellation occurs, the consumer must always and in any case assume the amount of the plane ticket when it has been issued and its reimbursement is not possible, regardless of whether the consumer exercises how many actions incumbent upon the issuing company.

Youth and Culture undertakes to provide consumers with all the contracted services contained in the Program, with the stipulated conditions and characteristics. However, the following considerations must be taken into account:

a. In the event that before the start of the Program, Youth and Culture is forced to significantly modify any essential element of the contract, including the price, it must immediately notify the consumer. The latter may choose to terminate the contract, or accept a modification to the contract. In the latter case, Youth and Culture will specify the changes made and their impact on the price of the Program.

b. The consumer must communicate the decision adopted as soon as possible, and in any case, within three days after being notified of the modification of the Program. In the event that the consumer does not notify Youth and Culture of his decision within three days, it will be understood that he opts for the resolution of the Program.

c. In the event that Juventud y Cultura is forced to cancel any of its Programs for reasons not attributable to the consumer, or in the event that the consumer chooses to terminate the contract under the provisions of sections a) and b) . Youth and Culture will offer the consumer an alternative Program of equal or superior quality, or will reimburse the consumer for all the amounts paid for the Program. In these cases, also Youth and Culture must compensate the consumer for breach of contract, the damages caused.

d. There will be no obligation on the part of Youth and Culture to compensate the consumer when the cancellation of the Program is due to reasons of force majeure.

and. There will also be no obligation on the part of Youth and Culture to compensate consumers in the event that the cancellation of the Program occurs due to not reaching the minimum number of people required for the effective realization of the same, which has been communicated to the consumer. In these cases, Youth and Culture will notify the consumer in writing, at least fifteen days before the start date of the Program, that the minimum number of participants has not been reached and that, therefore, the Program has been canceled . In this case of cancellation of the Program due to not reaching the minimum number of participants, the consumer will have the right to reimbursement of all amounts paid for the Program.

F. The differences and/or claims that, in the opinion of the consumers, arise during the development of the contracted Program, must be brought to the attention of the Organization responsible for the Program in the country of destination, in order to offer a satisfactory solution immediately. In the event that the solution proposed by the responsible Organization in the country of destination is not satisfactory to the consumer, they will have a period of one month to submit a written claim to Youth and Culture. This, after collecting the relevant documentation, will in turn have a period of one month to respond to the claim raised by the consumer. If the solution proposed by Youth and Culture is also not satisfactory, the consumer may initiate the corresponding actions.

The prices of all programs include VAT. All prices are subject to possible changes as a result of currency fluctuations, transportation rates, fuel costs, fees and taxes. Variations must be notified to the consumer in writing, who may, when the variation is significant (10%), withdraw from the trip without any penalty or accept the modification of the contract. In no case will the price of the Program be revised upwards in the twenty days prior to the start date.

The consumer must adapt to the way of life and customs of the country in which the contracted Program is developed. The rules of conduct in the countries of destination, the uses and customs, the meals, the schedules, the distances and, in general, the lifestyle of the countries in which the various Programs are carried out are usually very different from the way of life and usual customs in Spain. In this sense, the consumer must adapt to them. The consumer agrees to respect the laws of the country of destination in which the Program takes place, as well as the Disciplinary Rules of the various Organizations, Colleges, Centers, Universities, Schools, etc. that collaborate with Youth and Culture in carrying out the Program. In particular, the consumer agrees to attend class and to respect the conditions of consumption of tobacco, alcohol and drugs, etc. Youth and Culture will deliver to the consumer a copy of the Discipline Rules applicable to the various Programs.

In the event of non-compliance by the consumer with the laws of the country of destination in which the Program takes place or non-compliance with the Disciplinary Rules of the various Organizations, Colleges, Centers, Universities, Schools, etc., the consumer may be expelled from the Program. Program. In such a case, he must assume the expenses originated by his early return to Spain, apart from any other responsibility due to the intent or negligence of the participant.

The participant must inform Youth and Culture if he is undergoing any medical and/or pharmacological treatment during his stay in the country of destination and throughout the duration of the Program. It is understood that, at the start of the Program, the participant is in good physical and mental health and that the medical information, if any, provided to Youth and Culture is true and complete. Otherwise, Juventud y Cultura is exempt from any type of responsibility derived from the falsity of this information. If any participant in a Youth and Culture Program, a minor, is in a situation of needing medical treatment, and/or being hospitalized and/or undergoing surgery without being able to locate their parents or legal representatives, Youth and Culture is authorized to take the measures it deems most appropriate for the health of the consumer.

Consumers may enjoy, if they wish, the coverage of a multi-assistance insurance. A copy of the Insurance Policy is attached to the Program documentation. Consumers can carry another policy of their choice. In this, they must bring this circumstance to the attention of Youth and Culture.

Juventud y Cultura acts solely as an agent for the transport companies, so it is not considered responsible for delays, accidents, alterations to the route or loss of luggage. Youth and Culture also acts as an intermediary between consumers and insurance companies when an assistance policy is contracted through Youth and Culture.

All participants in the Youth and Culture Programs, including minors, must have their personal documentation in order (passport, DNI, etc.), in accordance with the regulations of the country where the contracted Program is developed. Obtaining this documentation will be borne by the consumer.

In compliance with article 5 of the L.O. 15/1999 on Data Protection, you are informed that the personal data requested is strictly necessary to serve you correctly to provide the services you have requested. They will be stored in the files that are the responsibility of Youth and Culture in order to provide the academic services requested by the interested party and carry out the corresponding administrative procedures, as well as send commercial communications by e-mail, SMS or by post, of products that may be of interest to you, to which you give us your consent. You may revoke such consent at any time.

Likewise, images in which you could appear may be captured, which will be stored and processed with the purpose of disseminating our activities in different media (social networks, magazines, etc.) to which you expressly consent, except protest against. You may revoke such consent at any time. (_) I do not consent to the use of my image. (check if you are not satisfied – provided in the inscriptions)

For the provision of the requested academic services with teaching in countries outside of Spain, we inform you that the international transfer of data will be necessary to those entities located both in a country within the EU, safe or unsafe, depending on the request made by the student. , being strictly necessary to be able to provide the service. The validity of these general conditions is that of the Prospectus of the current year. Any conflict related to the Programs will be resolved by the competent Jurisdictional Bodies according to the applicable legislation.

PARTICULAR CONDITIONS OF THE PROGRAMS: According to the contract signed between the parties, in each case, as well as those established for each program.
